Welcome to ClearBreath. By downloading, installing, or using the ClearBreath mobile application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, please do not use the App.

1. Description of Service

ClearBreath is a mobile application designed to help users quit smoking. The App provides tools including progress tracking, health recovery timelines, SOS breathing techniques, an AI-powered quit coach, relapse analytics, and achievement systems.

2. Medical Disclaimer

ClearBreath is not a medical device and does not provide medical advice. The App is designed for informational and motivational purposes only. Health recovery timelines are based on general scientific research and may vary between individuals.

  • The App is not a substitute for professional medical advice, diagnosis, or treatment.
  • Always consult a qualified healthcare provider for medical questions or concerns.
  • If you experience a medical emergency, contact emergency services immediately.
  • The AI Quit Coach provides general support and is not a licensed therapist or medical professional.

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activity under your account.

4. Subscriptions and Payments

4.1 Free Tier

ClearBreath offers a free tier with limited features, including basic progress tracking, SOS emergency system, daily tasks, and 3 AI messages per day.

4.2 Premium Subscription

Premium features are available through subscription plans:

  • Monthly: $9.99 per month
  • Annual: $69.99 per year

Both plans include a 7-day free trial for new subscribers.

4.3 Payment Terms

  • Subscriptions are billed through Apple's App Store.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel subscriptions in your App Store account settings.

4.4 Refunds

Refunds are handled by Apple according to their refund policy. We cannot process refunds directly.

5. User Responsibilities

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to the App's systems or other users' accounts.
  • Distribute viruses or malicious code through the App.
  • Use the AI Quit Coach for purposes unrelated to smoking cessation.
  • Reverse engineer, decompile, or disassemble the App.
  • Submit false or misleading information.

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design — are owned by ClearBreath and protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service.
  • You engage in fraudulent or illegal activity.
  • Your account poses a security risk.

You may delete your account at any time through the App settings. Upon deletion, your data will be permanently removed as described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law:

  • ClearBreath is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee that the App will be uninterrupted, error-free, or secure.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
  • We are not responsible for any health outcomes resulting from use of the App.

9. Indemnification

You agree to indemnify and hold harmless ClearBreath, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClearBreath operates, without regard to conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.
